Does the scoll devices qualify the name Android?

A central part of the operating system of Android devices is the ability to use the marketplace.
And as StorageOptions have decided not to release the sourcecode (GPL Violation) & we also no longer have marketplace support.

Does the Scroll Tablets have the right to call them Android Devices - Sure the operating system works (barely) and you can install (some) android apps. But beyond that i am even having problems installing alternate marketplace apps.

I would love a Qualified legal answer - but we know StorageOptions dont really care about us users much at all.

My tablet is more or less worthless to me unless i download apps using my PC & copying the apps to the memory card. And then installing from there - or just install apps via the browser that seems to be crashing a lot recently.

My personal opinion is that any Android device that does NOT have a fully working Market - Is depriving the user from the TRUE Android experience. It should be called an Android part based device instead.

(Fortunately my Scroll has a fully work Market) - but it is still gathering dust on top of the fridge.
