If you want to check if the network is Infrastructure or Ad-Hoc as mentioned by cb95amc then once more inSSIDer on your laptop will tell you.

iPhone hotspot is infrastructure.

Key was in the point you mentioned earlier, SSID characters. By using an app that recognizes different characters I thought I eliminated that issue, but on a second look into that app i realised that it does work for different alphabetical characters Japanese, Chinese etc, but not for apostrophe, and iphone does add an apostrophe to your name, doh.

went into iphone settings, removed apostrophe and hey presto new network recognized by the tablet in an instant.
